1. Introduction

These Terms and Conditions ("Terms") govern the provision of vinyl wrapping services by Elite Wrapz ("we," "us," "our") to customers ("you," "your"). By engaging our services, you agree to be bound by these Terms.

2. Definitions

  • "Services" means the vinyl wrapping and related services provided by Elite Wrapz
  • "Client" or "Customer" means the person or entity purchasing our Services
  • "Quote" means the written estimate provided for Services
  • "Materials" means vinyl wraps and associated products supplied by us
  • "Site" means the location where Services are to be performed

3. Quotations and Acceptance

3.1 Quotation Validity

  • All quotations are valid for 30 days from the date of issue
  • Quotes are based on information provided by the Client at the time of enquiry
  • We reserve the right to revise quotes if site conditions differ from initial information
  • Quotes exclude any work not specifically mentioned in the written quotation

3.2 Acceptance

  • A contract is formed when you accept our quote in writing and pay the required deposit
  • Acceptance may be by email, signed document, or payment of deposit
  • We reserve the right to refuse any order at our discretion

4. Pricing and Payment

4.1 Pricing

  • All prices are quoted in GBP (£) and include VAT where applicable
  • Prices are based on current material costs and may be adjusted if material costs significantly increase before work commences
  • Additional work beyond the original quote will be charged separately

4.2 Payment Terms

  • Deposit: A minimum 30% deposit is required to confirm booking
  • Balance: Full payment is due upon completion of work unless payment plan agreed
  • We accept payment by bank transfer, card payment, or approved payment plans
  • We reserve the right to retain possession of wrapped items until full payment is received

4.3 Payment Plans

  • We offer flexible in-house payment plans (Wrap-n-Relax™) for 3, 6, or 12 months
    • Payment plans are subject to separate terms and approval
    • Late or missed payments may result in additional fees and interest charges
    • We reserve the right to suspend or terminate services for non-payment

    4.4 Charitable Donations

    • We donate 5% of the project total (quote total minus deposit) to mental health charities through Work for Good
    • Example: For a £2,000 project with a £600 deposit (30%), the donation would be calculated as: £2,000 - £600 = £1,400 × 5% = £70 donated to charity
    • Donations are made to one of three UK Mental Health charities: MIND, YoungMinds, or CALM
    • You can choose your preferred charity at the time of booking

    4.5 Price Match Guarantee

    • We offer a price match guarantee on like-for-like quotes
    • Quotes must be from a legitimate, insured UK business
    • Must be for identical materials, scope of work, and service level
    • Price match must be requested before deposit payment

    4.6 Referral Scheme

    We operate a customer referral programme to reward our customers for recommending our services.

    4.6.1 How It Works

    • After completion of your project, you will receive a referral card
    • You can give this card to friends, family, or colleagues who may be interested in our services
    • When someone uses your referral card and completes a booking with us, both you and the new customer (referee) will receive benefits

    4.6.2 Referral Benefits

    • New Customer (Referee): Receives 10% discount off the total cost of their wrap project
    • Existing Customer (Referrer): Receives a refund calculated after the new customer's deposit is paid:
      • If you paid in full: 10% refund of your original project cost
      • If you paid via payment plan: 5% refund of your original project cost
    • Refunds will be processed within 14 working days of the referee paying in full, or within 14 working days of the referee's first monthly payment after deposit if they choose a payment plan

    4.6.3 Eligibility and Restrictions

    • Referral discount applies only to new customers who have not previously used our services
    • The referee must present or mention the referral card at the time of initial quote or booking
    • Referral discount cannot be applied retrospectively to existing quotes or bookings
    • Only one referral discount can be used per customer - customers who have been referred cannot subsequently refer others
    • Referral discounts cannot be combined with any other offers, promotions, or price matches
    • The minimum project value for referral scheme participation is £500
    • Referral cards are non-transferable and may not be sold or exchanged for cash

    4.6.4 Refund Method

    • Referrer refunds will be paid by the same method as the original payment where possible
    • If the original payment method is no longer available, refunds will be made by bank transfer
    • You must provide valid bank details or payment information to receive your refund

    4.6.5 Scheme Terms

    • We reserve the right to verify the legitimacy of all referrals
    • We reserve the right to refuse or cancel referrals where we suspect fraud, abuse, or gaming of the system
    • We reserve the right to modify, suspend, or terminate the referral scheme at any time with reasonable notice
    • Referrals made before any scheme changes will be honoured under the terms in effect at the time
    • The referral scheme is subject to these Terms and Conditions
    • Disputes regarding referrals will be handled in accordance with our Complaints Procedure (Section 14)

    4.6.6 Tax Implications

    • Referral refunds may be considered taxable income under UK law
    • You are responsible for declaring any referral refunds to HMRC if required
    • We recommend consulting with a tax professional if you have concerns about your tax obligations

    5. Site Requirements and Client Responsibilities

    5.1 Site Access

    • Client must provide safe, unobstructed access to the Site
    • Client must ensure adequate lighting, ventilation, and working space
    • Client is responsible for removing all items from work areas before installation
    • Parking must be available within reasonable distance of the Site

    5.2 Site Conditions

    • Surfaces must be clean, dry, and in good condition
    • Client is responsible for any repairs to damaged or unsuitable surfaces
    • We reserve the right to refuse installation on unsuitable surfaces
    • Additional charges may apply if surfaces require extra preparation

    5.3 Health and Safety

    • Client must inform us of any health and safety hazards at the Site
    • Client must ensure pets and children are kept away from work areas
    • We reserve the right to stop work if safety concerns arise

    6. Installation and Completion

    6.1 Scheduling

    • Installation dates are agreed upon booking confirmation
    • We will make reasonable efforts to complete work within estimated timeframes
    • Delays caused by factors beyond our control are not our responsibility
    • Rescheduling requests must be made at least 48 hours in advance

    6.2 Installation Process

    • Work will be performed during normal business hours unless otherwise agreed
    • Some disruption to normal activities should be expected during installation
    • We will make reasonable efforts to minimize dust and mess
    • Client must ensure someone over 18 is present during installation

    6.3 Completion

    • Work is complete when we deem it finished to professional standards
    • Client will be asked to inspect and approve completed work
    • Any concerns must be raised before final payment

    7. Materials and Finishes

    7.1 Material Selection

    • We use high-quality vinyl materials from reputable manufacturers
    • Client is responsible for final approval of colours and finishes
    • Colours may vary slightly from samples due to lighting and material batch variations
    • Digital images and samples are for reference only

    7.2 Material Characteristics

    • Some finishes may show fingerprints, water marks, or wear patterns more readily
    • Textured finishes may be more difficult to clean than smooth finishes
    • We will advise on the most suitable materials for your application
    • Material specifications and warranties are subject to manufacturer terms

    8. Warranties and Guarantees

    8.1 Workmanship Warranty

    • We guarantee our workmanship for a period of 12 months from completion
    • Warranty covers defects in installation such as peeling, bubbling, or lifting
    • Warranty does not cover damage from misuse, accidents, or improper care

    8.2 Material Warranty

    • Material warranties are provided by manufacturers and vary by product
    • Typical material warranties range from 5-10 years
    • Material warranties cover manufacturing defects but not wear and tear
    • We will facilitate warranty claims with manufacturers as needed

    8.3 Warranty Exclusions

    Warranties do not cover:

    • Damage from improper cleaning or maintenance
    • Normal wear and tear
    • Damage from impact, scratches, or cuts
    • Damage from excessive heat or chemicals
    • Peeling due to substrate failure
    • Colour fading from UV exposure (beyond manufacturer specifications)
    • Damage from alterations or repairs by third parties

    9. Care and Maintenance

    9.1 Cleaning Instructions

    • Clean with soft cloth and mild soap solution only
    • Avoid abrasive cleaners, solvents, and harsh chemicals
    • Wipe up spills promptly to prevent staining
    • Do not use pressure washers or steam cleaners

    9.2 General Care

    • Avoid placing hot items directly on wrapped surfaces
    • Use cutting boards - do not cut directly on wrapped surfaces
    • Avoid dragging heavy or sharp objects across surfaces
    • Keep wrapped surfaces away from direct heat sources

    10. Cancellations and Changes

    10.1 Client Cancellation

    • More than 14 days before scheduled start: Full refund minus £50 admin fee
    • 7-14 days before scheduled start: 50% refund of deposit
    • Less than 7 days before scheduled start: No refund
    • If materials have been ordered, material costs will be deducted from any refund

    10.2 Changes to Work

    • Changes to agreed work must be requested in writing
    • Changes may affect pricing and completion dates
    • We reserve the right to refuse changes once materials are ordered

    10.3 Our Right to Cancel

    • We may cancel or postpone work due to circumstances beyond our control
    • Full refund will be provided if we cancel before work begins
    • We are not liable for consequential losses if we cancel

    11. Liability and Insurance

    11.1 Our Liability

    • We maintain full public liability insurance
    • We are liable for damage directly caused by our negligence
    • Our liability is limited to the value of the contract
    • We are not liable for pre-existing damage or defects

    11.2 Limitations

    We are not liable for:

    • Indirect or consequential losses
    • Loss of profit, revenue, or business
    • Damage to items not removed from work areas
    • Delays beyond our reasonable control
    • Failure of substrates or underlying surfaces

    12. Intellectual Property

    • We may photograph completed work for marketing purposes
    • Client may request that their project not be used in marketing
    • All designs and specifications remain our intellectual property
    • Client receives a license to use installed materials at the specified Site

    13. Data Protection

    • We process personal data in accordance with GDPR and UK Data Protection Act
    • Personal data is used solely for providing Services and business purposes

    • Client consents to processing of personal data by accepting these Terms

    14. Complaints Procedure

    14.1 Making a Complaint

    • Complaints should be made in writing to contact@elitewrapz.uk
    • Include relevant details, photos, and supporting information
    • We will acknowledge complaints within 2 business days
    • We aim to resolve complaints within 14 days

    14.2 Resolution Process

    • We will investigate all complaints thoroughly
    • Site visit may be required to assess issues
    • Remedial work will be carried out if defects are confirmed
    • Disputes may be referred to independent arbitration

    15. Force Majeure

    We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:

    • Acts of God, natural disasters, extreme weather
    • War, terrorism, civil unrest
    • Government actions or restrictions
    • Material shortages or supply chain disruptions
    • Pandemics or public health emergencies
    • Strikes or labour disputes

    16. General Provisions

    16.1 Entire Agreement

    • These Terms, together with our Quote, constitute the entire agreement
    • No verbal agreements or representations are binding
    • Variations must be agreed in writing

    16.2 Severability

    • If any provision is found to be invalid, other provisions remain in effect
    • Invalid provisions will be replaced with valid provisions achieving similar effect

    16.3 Waiver

    • Failure to enforce any right does not constitute waiver of that right
    • Waivers must be in writing to be effective

    16.4 Assignment

    • We may assign or subcontract our obligations
    • Client may not assign their rights without our written consent

    16.5 Notices

    • Notices must be in writing and sent to the contact details provided
    • Email notices are deemed received when sent
    • Postal notices are deemed received 2 business days after posting

    17. Governing Law

    • These Terms are governed by the laws of England and Wales
    • Disputes will be subject to the exclusive jurisdiction of English courts
    • Consumer rights under UK consumer protection law are not affected

    18. Consumer Rights

    If you are a consumer, you have certain statutory rights including:

    • Right to expect services to be provided with reasonable care and skill
    • Right to expect services to be provided within a reasonable time
    • Right to cancel within 14 days for off-premises or distance contracts
    • These Terms do not affect your statutory consumer rights
